TAC Vehicle Damage Cover?

Hey guys,

I've got a friend that brought some rims off me, not the point though haha.

The story is that he was travelling down the calder freeway where the roadworks are near the BP service station outbound, there is a rise in the road where they have started the new road from the old one.

Anyway my friend hit this bump in the road and it punctured one of his tyres, does he have any right to claim damage with TAC or Vicroads, im not too sure what is the way to go on this subject.

can, but good luck, brother tried with main roads, and they said it wasnt their responsibility to look for faults in the roads and that he has to be more aware

He can try but it's not likely. They will just say he ran over glass or something and it wasn't their fault.

Geez...I would have thought that if they are doing roadworks and leave it in a state that can obviously cause damage to a vehicle then they would/should be liable.
I'd be taking photos and contacting Vicroads by phone and by mail.

yeah nah with the severity of damage I am sure you can get a new car out of it.

who do tac, local council and vicroads think they are, this is an outrage, a punctured tyre from our roads, this is unheard of.

Listen mate no need to be a smart@ss, i wasnt saying OMG he punctured a tyre give him a new car damn it...did you hear me say that????

However I dont think it is unreasonable to expect vicroads, tac or whoever to replace a tyre due to their unfinished work.

So maybe next time have a think about what you are going to say before you get another case of verbal diarrhoea

if they are performing roadworks then they do have a duty of care, they can't leave it in a condition that would be likely to damage something. However if your brother is the only one that claims damage it would be a bit hard to prove as they would say 1000's of cars drove over it and yours was the only one.

Areas that are on around roadworks are 40kph.
The Step from old to new surface is usally about 20-30mm and has a radius.

To cause a punchure, it would have to be at a higher speed, or the tyre was either over or under inflated.

Pretty sure 1000's of people use the Calder Freeway. You'd have a case if there were 100's of cars on the side of the road all from the same thing.

Tell ya mate he stuffed up and to buy a tyre.

Yeah sorry mate when the tyre is ruined beyond repair and it is a $300 hankook tyre, most of the time $20 wont get the job done......wow verbal diarrhoea yet again maybe you should see a doctor about that

Yeah I figured that was most likely the case, I didnt know about the 40km speed limit though.

how fast was your mate travelling.. ?

by the sounds of it... too fast.. ie.. road work speed limits are a lot slower.. ... or as mentioned also.. tyred improperly inflated..

if the speed was a reason.. i'd say there is no case to answer.. and your mate will just have to fork out the cash to replace the tyre.. :S

Yeah I'd say he was most likely travelling over the limit 40kph wouldnt do that to his tyre.

The tyre was properly inflated though, but yeah I'd say there is no case here was just interested if anyone had a similar thing happen and what they did.

TAC look after personal injuries NOT car or mechanical repairs.

You mean the Council don't you, NOT the Transport Accident Commission ?

Well im assuming it would be the people that handle the roadworks, I just wasnt too sure because it is a highway, so would council rules apply?
